By downloading or using TalkyZoo, the parent or legal guardian confirms that they have read and agree to these Terms of Use and to our Privacy Policy.

1. About TalkyZoo

TalkyZoo is an English learning app for children aged 4 to 7. It is developed and operated by Nuvens Grampeadas Ltda, CNPJ 66.465.087/0001-80, based in Brazil ("we", "us"). The app teaches English vocabulary through games, songs, karaoke, voice recognition and spaced repetition. TalkyZoo contains no advertising.

2. Parental Responsibility

TalkyZoo has no accounts or sign-up. The app should be set up by a parent or legal guardian aged 18 or older.
The parent or guardian is responsible for the child's use of the app and for keeping access to the Parents' Area secure.
Purchases can only be made through the Parents' Area. Children should not make purchases without an adult.
Multiple child profiles can be created in the app. Profiles and progress are saved on the device only.

3. Plans and Payments

TalkyZoo offers three Premium plans with full access to the app:

Monthly: a subscription billed every month.
Annual: a subscription billed once a year.
Lifetime: a one-time purchase with permanent access, with no recurring charges.

Monthly and Annual subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before the renewal date. If a free trial is offered, it converts automatically into a paid subscription unless cancelled at least 24 hours before the trial ends.

All payments are processed by the Apple App Store or Google Play. We do not collect or store payment information. Current prices are shown in the store before purchase.

4. Cancellation and Refunds

Monthly and Annual subscriptions can be cancelled at any time in your App Store or Google Play account settings. Deleting the app does not cancel a subscription. After cancellation, Premium access stays active until the end of the period you paid for.

The Lifetime plan is a one-time purchase and does not renew. It can be restored on other devices that use the same store account through the "Restore Purchases" option.

Refunds are handled by the Apple App Store or Google Play under their own policies.

5. Voice Recordings

TalkyZoo uses the microphone so children can practise pronunciation and sing along in karaoke. Voice recognition is processed on the device. Recordings a child chooses to save stay on the device and can be deleted at any time in the Parents' Area. For details, see our Privacy Policy.

6. Permitted Use

TalkyZoo is licensed for personal, non-commercial use only. You may not:

copy, distribute or modify any app content;
use the app for commercial or classroom purposes without written permission;
attempt to reverse engineer, access or modify the app's source code.

7. Intellectual Property

All TalkyZoo content, including characters, illustrations, audio, music, games and text, belongs to Nuvens Grampeadas Ltda and is protected by copyright and trademark law. TalkyZoo™ is a trademark of Nuvens Grampeadas Ltda.

8. Privacy and Children's Data

We take children's privacy seriously and follow the Brazilian General Data Protection Law (LGPD) and applicable store policies for children's apps. How we collect, use and protect data is described in our Privacy Policy.

9. Limitation of Liability

TalkyZoo is a learning support tool and does not replace formal English teaching. We do not guarantee specific learning results. To the extent permitted by law, we are not liable for indirect damages arising from use of the app. Nothing in these Terms limits your rights under the Brazilian Consumer Defense Code.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced in the app before they take effect. Continued use after a change means you accept the updated Terms.

11. Governing Law

These Terms are governed by the laws of Brazil. Disputes will be settled in the courts of the consumer's place of residence, as provided by Brazilian consumer law.
